Terms of service
These terms govern your use of Lulu Marketing (the "Service"), provided by BuzzSpark E Services Private Limited, with its office at B-98, Sector-C, Near Wireless Chauraha, Mahanagar, Lucknow - 226006, Uttar Pradesh, India ("BuzzSpark", "we"). Lulu Marketing is a brand of BuzzSpark. By creating an account or using the Service you agree to them on behalf of yourself and the business you represent.
1. The Service
Lulu Marketing helps businesses plan, run and measure marketing across channels including Meta (Facebook, Instagram, WhatsApp), Google Ads, SMS, voice and offline media, and connects them with vendors through our partner network.
2. Your account
- You must give accurate information and keep your sign-in secure. You are responsible for activity under your account.
- You must be authorised to act for the business you register, and to connect any ad account, Page, Instagram account or WhatsApp number you connect.
3. Connected platforms
- When you connect a third-party platform, you authorise us to access it and act on it as you instruct, within the permissions you grant. You can disconnect at any time.
- Your use of those platforms remains subject to their own terms and policies, including Meta's Terms, Advertising Standards, Commerce Policies and WhatsApp Business policies. You are responsible for your ads, posts, messages and lead forms complying with them and with Indian law.
- Platforms may change or withdraw features, rate-limit us, or suspend access. We are not liable for their actions.
4. Ad spend and fees
Our subscription plans and their prices are listed on our pricing section, or in a written order agreed with you, which takes precedence. Ad spend is billed by each platform directly to your payment method, not by us, unless we agree otherwise in writing. Vendor charges booked through the partner network are shown before you confirm a booking. Prices are exclusive of GST unless stated. Billing cycle, payment due dates and refunds are as stated in your plan, order or invoice.
5. Acceptable use
You may not use the Service to send spam or unsolicited messages; to run misleading, unlawful or discriminatory ads; to infringe others' rights; to scrape or misuse others' data; or to interfere with the Service or its security.
6. Your content and data
You keep ownership of your content and data. You grant us the rights needed to host, process and display it to provide the Service. How we handle personal data is described in our privacy policy. Where we process personal data on your behalf, we do so on your instructions, and you are responsible for having a lawful basis for it, including valid consent for marketing messages.
7. Availability and changes
We work to keep the Service available but do not guarantee it will be uninterrupted. We may change features; we will give notice of material changes that reduce what you have paid for.
8. Liability
To the extent the law allows: the Service is provided "as is"; we are not liable for indirect or consequential losses, lost profits, or the performance of your ads; and our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. Nothing limits liability that cannot be limited under law.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or end access for breach of these terms or where the law or a platform requires it. On termination we delete your data as described in the privacy policy.
10. Law and disputes
These terms are governed by the laws of India. Courts at Lucknow, Uttar Pradesh have exclusive jurisdiction.
